Welcome to GMVBest. These Terms of Service (hereinafter, the "Terms") represent a legally binding agreement between you (including individuals or legal entities acting as advertisers, agencies, or business partners registering for our services, hereinafter the "User") and GMVBest (hereinafter, "we", "us", or "our"), governing your use of our mobile ad measurement and marketing attribution system. By accessing our services, you acknowledge you have read, understood, and agreed to these Terms.
1. Account Activation & Service Scope
GMVBest provides unified cross-channel attribution modeling, analytics, ROAS tracking, and invalid traffic (IVT) verification (Fraud Guard). As an enterprise-focused B2B platform, we do not support open public self-registration. To register or activate an account, Users must submit requests via contract@gmvbest.com to sign a formal Master Services Agreement (MSA), upon which system administrators will provision specific console access credentials.
2. User Rights & Obligations
By utilizing our attribution measurement system, Users agree to the following obligations:
- Regulatory Compliance: Users warrant that their application packages, web pages, and creatives comply with all applicable local and international regulations. No malware distribution or deceptive advertising configurations are permitted.
- Privacy Declarations & User Consent: As Data Controllers, Users must maintain a conspicuous privacy policy disclosing the collection and processing of hardware identifiers for attribution and invalid traffic audits, obtaining user consents where required by systems or laws.
- Security of Credentials: Users must preserve console passwords and API callback credentials. Users bear full responsibility for configurations, changes, or postback integrations executed via their accounts.
3. Platform Rights & Obligations
We strive to optimize reliability and safety of the attribution platform, reserving the following rights:
- Service Availability: We utilize scalable, distributed cloud infrastructure to provide low-latency postbacks and calculations. However, we are not liable for temporary service interruptions due to force majeure, hardware failures, or carrier backbone outages.
- Security Controls: We reserve the right to throttle or block incoming API streams or IPs automatically if we detect high-frequency DDoS events or massive click injection spamming, defending platform load and User budgets.
- Adaptive Updates: We reserve the right to modify or update our measurement frameworks, SDK configurations, and callback paths dynamically to remain compliant with privacy upgrades (e.g., Apple iOS or Android updates).
4. Intellectual Property
All software, proprietary attribution code, dashboard layouts, SDKs, user manuals, logos, and trademarks associated with the GMVBest platform are the exclusive intellectual property of GMVBest or its affiliates. Reverse engineering, decompiling, or unauthorized distribution of our SDKs or APIs is strictly prohibited.
5. Disclaimers & Indemnity
We provide attribution analytics according to industry-standard probabilistic and deterministic paradigms. We do not warrant that our attribution aggregates will match ad network dashboards perfectly due to differences in self-attribution (SAN) windows and policies. We disclaim all liability for financial losses, overspend, or data disputes arising from incorrect User callback configs or failure to obtain consents.
6. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of the Platform's operating entity. Any disputes arising from or in connection with these Terms shall be resolved amicably; if negotiations fail, either party may file litigation in the court of competent jurisdiction where the Platform's operating entity resides.
